This website, qyneticlabs.com (the “website”), is operated by Qynetic Labs Private Limited, a company incorporated under the Companies Act, 2013 with Corporate Identity Number U26107TN2026PTC194272, whose registered office is at Plot No. 8, Door No. 283, Bharathi Nagar, Balaji Nagar Extension, Ponneri, Tiruvallur District, Tamil Nadu 601204, India (“Qynetic Labs”, “we”, “us” or “our”).
These Terms of Use (the “terms”) form an electronic record under the Information Technology Act, 2000 and the rules made under it. They apply to everyone who visits or uses the website (“you”). If you do not agree with them, please do not use the website. If you use the website on behalf of an organisation, you confirm that you are authorised to accept these terms for it.
Our Privacy Policy, Cookie Policy and Disclaimer also apply and are part of these terms.
Using the website
You may use the website to learn about Qynetic Labs and our products, and to contact us. You agree not to:
- use the website in any way that breaks the law, or for any fraudulent or harmful purpose;
- copy, scrape, harvest, frame, mirror or republish the website or its content, whether by hand or with automated tools, except as these terms allow;
- try to get around the technical measures that protect the website and its content, including measures that limit copying and selection of text and images;
- probe, scan or test the website’s security, or try to gain unauthorised access to it or to our systems, other than as our Security policy allows;
- interfere with the website’s operation, including by overloading it, sending spam through its forms or introducing malicious code;
- impersonate anyone, or misrepresent your connection with any person or organisation, including Qynetic Labs.
We may suspend, restrict or end access to the website, in whole or in part, at any time, without notice, including if we reasonably believe you have broken these terms.
Product information
The website describes our products and technology, including the Vayu family of boards, QyneticOS, QyneticRT and QChip, several of which are in development. Unless we say otherwise:
- specifications are from the current design, or are indicative or design targets, and may change at any time;
- images of boards are renders of our design files, not photographs of finished products;
- planned products, features, certifications and timelines are plans, not promises, and may change or be withdrawn.
Nothing on the website is an offer to sell, a quotation or a contract for any product or service. We do not sell products or take payments through the website. Any future sale will be governed by separate written terms. See the Disclaimer for more.
Early access, enquiries and applications
Registering interest, asking for early access or sending an enquiry through the website is not an order, a reservation or a commitment by either side. We may or may not offer early access, and we choose who receives it. Sending a job application does not create an employment relationship or an obligation to make an offer.
When you send us information through a form, you confirm that it is accurate, that it is yours to share, and that it does not include anything you are under an obligation to keep confidential. Please do not send confidential or proprietary information unless we have first agreed in writing to receive it under a non-disclosure agreement. If you send us ideas, suggestions or feedback, you agree we may use them without restriction or payment to you.
Intellectual property
The website and its content, including its text, design, layout, graphics, illustrations, renders, 3D models, animations, code samples, software and the selection and arrangement of all of these, are owned by Qynetic Labs or our licensors and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999 and other laws of India and other countries.
“Qynetic”, “Qynetic Labs”, “Vayu”, “QyneticOS”, “QyneticRT”, “QChip” and the Q logo are trade marks of Qynetic Labs. You may not use them without our prior written permission, except to refer to our products accurately and without suggesting any endorsement or affiliation. Logos in our media kit may be used, unaltered, to refer to Qynetic Labs.
We grant you a limited, personal, non-exclusive, non-transferable and revocable permission to view the website in a web browser for your own information. No other right or licence is granted. In particular, you may not copy, reproduce, modify, distribute, sell or create derivative works from any part of the website, or use it to train machine-learning models, without our prior written permission.
Names and marks of other companies, such as those of chip, software and standards organisations, belong to their owners and are used on the website only to identify their products.
Links to other websites
The website links to websites we do not control, such as government portals and our team members’ profiles. We are not responsible for their content, availability or privacy practices, and a link is not an endorsement. You use them at your own risk and under their terms.
Availability and changes
We work to keep the website available and accurate, but we do not guarantee that it will be uninterrupted, error-free, secure or free of harmful components, or that any information on it is complete or up to date. We may change, suspend or withdraw any part of the website at any time.
Disclaimer of warranties
To the fullest extent permitted by law, the website and everything on it are provided “as is” and “as available”, without warranties or representations of any kind, whether express or implied, including any warranty of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement. Information on the website is general information, not professional, technical, legal or investment advice.
Limitation of liability
To the fullest extent permitted by law, Qynetic Labs, its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with the website or your use of it, even if we were told such loss was possible.
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under the law of India.
Indemnity
You agree to indemnify Qynetic Labs and its directors, employees and agents against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of the website.
Privacy
We process personal data you send us in line with our Privacy Policy and the Digital Personal Data Protection Act, 2023.
Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Changes apply from that date; your continued use of the website after that means you accept them.
Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or the website, are governed by the laws of India. Subject to applicable law, the courts at Chennai, Tamil Nadu have exclusive jurisdiction.
General
If any part of these terms is found to be invalid or unenforceable, the rest remains in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor. These terms, together with the policies they refer to, are the entire agreement between you and us about the website. They are written in English; any translation is for convenience only.
